Foley: Pro-life beliefs are driving efforts

After two days of tiptoeing around the issue, Sen. Mike Foley acknowledged Thursday that his pro-life beliefs and his disgust with Planned Parenthood are driving his efforts to redistribute funding for women’s health services.

“I am pro-life to the core, with no apologies,” said Foley, who said he is working to make sure Planned Parenthood doesn’t get state funding.

“They are to abortion what McDonald is to cheeseburgers,” the Lincoln senator said. “They do more than anyone else.

“And that’s what this is about.”

Foley’s announcement on the floor of the Legislature came after a letter he sent to some supporters last week became public.

In the letter, Foley said his budget amendment would “at least begin to cut into the disbursement of our tax dollars to Planned Parenthood.”

And he asked people to pray that the amendment would prevail.

The issue goes beyond limiting funding to Planned Parenthood, Foley also acknowledged Thursday. He said he also doesn’t want state tax dollars going to other family planning clinics that offer abortion referral and information, even if they don’t provide abortions.

A number of senators were incensed by what they called Foley’s duplicity: his insistence this week that his primary concern was to broaden the number of clinics that could get the money and provide better distribution of services across the state.

Honesty and integrity is all that senators really have with each other, Sen. Don Pederson of North Platte said during two hours of debate on the issue Thursday.

“I believe we were deliberately deceived,” he said.

“I’m disappointed,” said Lincoln Sen. DiAnna Schimek. “I don’t think from the comments that one could extrapolate that he was trying to destroy funding for the services already there,” she said.

“I’m afraid I was deceived, and I feel betrayed,” said Sen. Joel Johnson of Kearney, who quoted from the Bible, “Thou shalt not bear false witness.” And he repeated the common saying, “Fool me once, it’s your fault. Fool me twice, it’s mine.”

“There won’t be a second time,” Johnson said.

Several senators also said they intend to revisit the funding distribution language during second-round debate.

But Foley said senators should not have been surprised by his motives, since he had been open about his dislike of family planning clinics during two public hearings held by legislative committees.

Sen. Pam Brown of Omaha said the abortion debate detracts from the real issue: family planning. It’s about whether women should have the opportunity to get information so they don’t get pregnant and don’t have to consider an abortion, she said.

In an interview after the debate, Foley said he has not made an issue about contraception or the fact state funds go to clinics that provide information about contraception and give prescriptions for birth control.

But he did not directly answer a question about whether he believes tax dollars should not go to clinics that provide birth control and birth control information.

“I have not said that,” he said.

What’s at stake: State tax dollars used to reimburse about 36 family planning clinics across the state, primarily for giving low-income women Pap smears and testing for sexually transmitted disease.

What has happened: A plan proposed by Sen. Mike Foley was added to the main budget bill during the first stage of debate. It requires Health and Human Services to use a different bid system when the agency decides where to spend tax dollars. Senators also increased the funding for next year from about $519,000 to $750,000. The bill still has two more rounds of debate before final passage.

What’s the controversy: The language directing a new bid process will likely cut or eliminate funding for family planning clinics that have traditionally provided the services, including two Planned Parenthood clinics in Lincoln. These clinics also provide a full range of family planning services, including prescriptions for birth control pills and abortion information and referral.

I'm so tired of old people, and men entirely, who think they have the right to force their opinion on someone in a situtation they have never or will never face... I saw some 100yr old man driving around with all this "pro-life" stickers on his car... funny, there weren't any anti-war or anti-death penalty stickers... because "pro-lifers" in general are "pro-birth"... they don't give a f*ck what happens after the baby is born... just look at the high number of children in foster care in this state. Why don't they take some of them into their homes? Adoption is great, except that most people only want healthy white babies... Whatever. What do you expect from people who take their orders from some old dude who's completely out of touch with reality and modern life (the Pope).

Babies don't just up and die from "blunt force trauma" if no one hits them. How could you not know how it happened? Retarded people are smarter than that. He's constantly trying to impose his Catholic viewpoint through law-making (notice he has 6 children) Not only is he anti-abortion, he's also anti-birth control and is doing his best to get rid of any government subsidies for contraception and family planning. Another ass who obviously thinks a woman's only purpose is to be a baby factory.....

LINCOLN - The mansions are right across the street. Up on the corner are the fancy SouthPointe Pavilions shopping center, retailers for every need and restaurants for every taste.

The New England style, the brick accents, even the vaguely suburban name - Wood Bridge - don't let on that these town houses are public housing. But that's what the Lincoln Housing Authority has built in south Lincoln.

One of the newest Lincoln public schools, Lincoln Southwest High, is less than a mile away. And Lincoln's fringe, where this suburban style meets farm field, isn't much farther.

The pounding and buzzing of home construction announce that more development is coming to south Lincoln. Yet Lincoln is quietly making a statement that the prosperous parts of the community are places for everyone.

In the middle of Lincoln's hot spot for growth, local housing leaders have carved out a place for affordable housing in the form of 130 apartments and town houses. The New England style, the brick accents, even the vaguely suburban name - Wood Bridge - don't let on that this is public housing.

That's by design, says Larry Potratz, executive director of the Lincoln Housing Authority, who proudly displays the organization's inroads on integration. It's a model the housing authority has followed in a second development nearby and soon will repeat at a third.


yeah, that's all verrrrry nice. Except that the Housing Authority only helps you if you have kids... so if I'd been irresponsible and spawned even though I couldn't take care of it, I'd be in. Nothing like rewarding irresponsible behavior... it's just like that shiny-eyed fundy freak state Senator of ours, Mike Foley. He wants to remove the welfare cap on women who have children 10 months or more after going on welfare... because he's afraid it encourages abortions... whatever. Why should people be rewarded for having more kids when they can't afford the ones they have, and expect the rest of us to pay for it?

The housing thing made me depressed and bitter because I had been working on an article about gentrification and displacement of the poor, which had a cite to a book by David Shipler, The Working Poor: Invisible in America "examining the 'forgotten America' in which citizens live consistently close to poverty despite a willingness to work hard and where a car breakdown or a brief illness can lead to an irreversible downward financial spiral" ... welcome to my world. Silly me. Instead of going to college, I should have just started popping out illegitimate children... I'd be getting a free ride now. I've decided if I got a serious illness, I'll just kill myself, because I'm having trouble paying off the tests and minor "surgery" I had last fall, and I ::have:: insurance...

Man charged with murder in stillbirth

An Omaha man has been charged with murder of an unborn child - the first time such a charge has been used in Douglas County when a woman survived an assault but her unborn child did not.

Delayno Shackelford, 19, of Omaha appeared in court today on charges of murder of an unborn child, attempted first-degree assault and false imprisonment. He is being held on $1 million bail. He must pay 10 percent - or $100,000 - to be released from jail.

Shackelford was arrested Friday after Omaha police investigated an assault on Crystal Lilly, 18, his live-in-girlfriend, who was eight months pregnant.

The prosecutor alleged in court that Shackelford woke Lilly about 2 a.m. and accused her of cheating on him. Shackelford then picked her up, threw her on the bed, straddled her and began choking her, the prosecutor said.

At some point, the prosecutor said, Shackelford told Lilly that he didn't want the baby and that she didn't deserve the child.

Lilly was treated at Mercy Hospital in Council Bluffs for injuries that police attribute to an assault.

Lilly returned to the hospital later and gave birth to a stillborn girl. The baby's preliminary cause of death was reported as severe blunt trauma to the head, police said.

The prosecutor said the trauma was severe enough to causes massive fractures to the baby's skull.

Shackelford and Lilly have been in a long-standing relationship and already have a child together, according to Shackelford's brother, Peere Shackelford.

The two share an apartment near 72nd Street and Interstate 80. Shackelford told a judge today that he doesn't have a regular job. He said he supports himself with a record label.

Peere Shackelford said he knew the couple got into an argument but didn't believe that the baby died as a result of the fight and didn't think his brother should be prosecuted.

"Domestic abuse is a given," he said. "He should never have put his hands on a pregnant woman."

Friday's events weren't the first time that Omaha police have been called to a dispute between the couple.

Officers called to their apartment on Sept. 10 took photographs of Lilly's injuries, according to police reports.

Lilly told officers that she and Shackelford had gotten into a fight, but she was reluctant to press charges, the reports said. Officers saw bruises, red marks and small cuts on Lilly's face, neck and arm, the reports said.

Shackelford was charged with assault and battery and disorderly conduct. The case was dismissed, however, because Lilly didn't show up to testify at his trial.

Prosecutor Shelly Stratman said Lilly was the only person who could identify Shackelford in court because she was the only witness.

Nebraska's fetal homicide law was passed in 2002. It provides for a criminal charge if a fetus dies when a pregnant woman is assaulted or injured.

Douglas County prosecutors have used the charge twice in homicides of pregnant women.

William Floyd was sentenced to life in prison plus an additional 20 years for shooting into a house in October 2003. The shots killed 20-year-old Destiny Davis, who was several months pregnant.

In August, Bobby Moss was sentenced to 65 to 100 years in prison after being convicted of second-degree murder in the death of 17-year-old Michelle Harlan and the manslaughter of her unborn child.

The law also was used in June 2004 in a motor vehicle case in which a pregnant woman's unborn baby died.

The other car's driver was convicted of driving while intoxicated and causing the death of an unborn child.

Mom now pleads not guilty in death of daughter

LINCOLN (AP) - A mother accused of smothering her 17-month-old daughter changed her plea to not guilty from "not responsible by reason of mental defect."

Jodi Yager, 22, of Cedar Bluffs, changed her plea at a status hearing Monday morning in Saunders County District Court.

She will continue to be held at the Lincoln Regional Center, said Saunders County Attorney Scott Tingelhoff. A status hearing was set for March 27, and a trial date was set for April 11.

Saunders County Judge Mary Gilbride had previously ruled Yager incompetent to stand trial after two psychiatrists said she did not understand the court system and why she was being charged.

But in late January, Yager was declared competent after undergoing psychological evaluation and therapy at the Lincoln Regional Center for about two months.

Yager is charged with intentional child abuse resulting in the death of her daughter, Andrea Yager, in November. Yager could face up to 20 years to life in prison if convicted.

A court affidavit said Yager placed one of her hands over her daughter's mouth and nose for at least five minutes, causing the child to stop breathing.

I shop at Wal*Mart (or Mao*Mart as the aforementioned site refers to them, and given the amount of goods made in China they sell, it's not an unfair sobriquet) I do buy a lot of my clothes second-hand, and drive a used car, at least...
