Police say a man shot at his neighbor with a crossbow after they argued over the breed of a dog Saturday.
Carlos Lupercio, 49, 1009 N. 30th St., No. 2, allegedly started arguing with a 25-year-old man about the breed of the younger man’s dog on the sidewalk on Apple Street between 29th and 30th streets just before 5 p.m., Lincoln Police Officer Katie Flood said.
The owner said the dog was a pit bull, but Lupercio said it was a lab, Flood said.
Lupercio went home and allegedly returned about 20 minutes later with a crossbow pistol, Flood said. The other man tried to extend his arm in apology, but Lupercio allegedly fired the crossbow at him as he was walking away, Flood said.
The man was only two or three feet away when Lupercio allegedly fired, Flood said. The arrow just missed the other man, hitting a tree instead, Flood said.
Lupercio allegedly was still holding the weapon when officers arrived, Flood said. When officers tried to arrest him, Lupercio, who was in a wheelchair, allegedly resisted them.
Lupercio was arrested and jailed on suspicion of terroristic threats, use of a weapon to commit a felony, discharging a weapon within city limits, resisting arrest, failure to comply, marijuana possession and possession of drug paraphernalia, Flood said.
Police believe alcohol was a factor in the incident, she said.

Police who were called to an assault Monday night were called back to the same residence later that night after a man allegedly killed a dog with a machete.
Police were called to 1415 S. 10th St. around 6:30 p.m. on a report of an assault between two women, Officer Katie Flood said. Jessica Goff, 26, who lives there with her boyfriend, had decided she wanted two other roommates, Leonard Yankton, 32, and Meri Backensto, 29, to move out, Flood said.
They began to argue because a floor had been scratched by some belongings being moved, Flood said.
Goff and Backensto, who were cited on suspicion of assault, left the residence after police left, but Yankton allegedly was still unhappy about being asked to leave, Flood said. He called police around 8 p.m. and said Goff’s female pit bull had attacked him, so he struck it multiple times with a machete.
The dog was taken to an emergency veterinary clinic, but it did not survive. The veterinarian told police the animal’s injuries appeared inconsistent with an attack, Flood said. The vet said it appeared Yankton had tried to chop the dog’s head off as it was lying down on the floor.
Yankton was cited on suspicion of cruelty to animals, a Class IV felony.
Yankton had lived with Goff for a while, and his dog had mated with the pit bull and sired puppies, Flood said. He didn’t appear to have any problems with the animal prior to Monday night.
Police responded a disturbance call at the same residence late last month and ended up arresting five people, including Goff, who was arrested on warrants for failure to appear on a number of traffic violations.

What a joke.Man sentenced to jail in crash that killed girlfriend, daughter

OMAHA-- An Omaha man was sentenced Monday to six months in jail for motor vehicle homicide in a crash that killed his girlfriend and their 2-year-old daughter.
Police said Adam Viktora, 21, had drugs and alcohol in his system when the sport utility vehicle he was driving slammed into a car in August 2005.
Passengers Melinda Schwengels, 21, and daughter, Adrienna, were both killed. Police estimated that Viktora was going 54 mph in a 30 mph zone. Judge Peter Bataillon found Viktora guilty of two counts of misdemeanor motor vehicle homicide, deciding against felony charges.
Viktora’s attorney, Mikki Jerabek, said Viktora is remorseful and wants to serve his jail time. He will spend two years on probation after serving his sentence.
Schwengels’ family said they were too upset to talk after Monday’s sentencing.
You get more time for property crimes in this state. Channel 10/11 had a feature about kids who get in trouble a couple of weeks ago. Some kid is doing 12 YEARS for arson, for starting a fire in a house that was being built. No one was living there, no one died, yet he's in for that long. Some piece of crap kills his girlfriend and their daughter while doped up and gets 6 MONTHS?!?! He's probably relieved he doesn't have the responsibility of a family to interfere with his partying. Police say 12-year-old drove drunk grandma

A 50-year-old woman is accused of taking her 12-year-old granddaughter along to break out five windows at a distant relative’s home Monday night. Actually, police say the 12-year-old took her.
When they stopped a maroon Chevy Cavalier believed to be responsible, police found the woman, Vickie Britton, 2410 Holdrege, drunk and the preteen behind the wheel.
Officer Katherine Finnell said a relative spotted Britton in the front yard of a duplex at 31st and Starr about 8:15 p.m. The witness told police she saw the woman pick up a chair from the front yard and use it to break five windows at the duplex, causing an estimated $400 damage.
She and a girl got into the Chevy and drove away. But when the car returned at 9:40 p.m., the witness called police again.
Police spotted the car nearby and stopped it to make the surprising discovery of the young driver.
Finnell said Britton was intoxicated and belligerent. Police arrested her on suspicion of vandalism and child neglect and ticketed her for allowing an underage person to drive.
Police referred the girl to the Lancaster County Attorney’s office for driving without a driver’s license.

10-year-old girl charged in store attack

BOSTON -- A gang of girls attacked a woman at a discount store, hitting and kicking her and tearing off her clothes, said police, who arrested a 10-year-old girl accused of being involved.
The girl, who was not identified, was charged with assault and battery for kicking the 22-year-old woman in the head and stomach on Sunday, said Officer Eddy Chrispin.
The three other girls were not arrested, but police said they would seek criminal complaints against them. Their names and ages were not released.
The woman apparently had bumped into the 10-year-old girl in an aisle at a Target store and refused to apologize, Chrispin said. Witnesses told police the four girls then knocked the customer to the floor "where she was being hit, her hair was being ripped out, and her pants were taken off," he said.
The victim was treated at a hospital.

Why meth dealers should get the death penalty...Suspect in Spencer murder pleads not guilty

SPENCER, Iowa -- The last of 10 suspects believed to have been involved in the 1997 kidnapping and murder of Gregory "Sky" Erickson pleaded not guilty Monday to murder and kidnapping.
Juan Humberto Castillo-Alvarez, 32, is charged in Clay County District Court with one count each of second-degree murder, second-degree kidnapping and conspiracy to commit a forcible felony. If convicted, he would face prison sentences of 50, 25, and 10 years, respectively.
District Judge Don E. Courtney scheduled trial for Dec. 5. Castillo-Alvarez remains jailed on a $1 million bond.
Castillo-Alvarez was extradited to Iowa from Houston earlier this month after being returned to the United States from Mexico. He was charged in 2004 in the death of Erickson, 15, of Estherville, Iowa.
Erickson's body was found in an abandoned farmhouse near Jackson, Minn., just across the Iowa border. He had been beaten and shot in the head execution style.
He was coaxed from a golf course, taken to a Spencer, Iowa, apartment, where he was beaten by a group of people and had a gun barrel shoved down his throat, causing him to vomit. He was then taken back to Estherville, where he was beaten again, then placed in a trunk of a car and driven to the farmhouse, where he was shot.
Authorities have said he was involved in a drug ring and had feared for his life because he owed money to the people who were charged in his death. Nine people have been convicted of felonies in connection with his death and sentenced to prison.

KEOSAUQUA, Iowa (AP) -- Shawn Bentler appeared in court Tuesday on five counts of first-degree murder for the slayings of his parents and three younger sisters.
Bentler, 22, made a brief appearance in a Van Buren County courtroom that was packed with relatives and media covering one of the worst mass murders in Iowa history.
Bentler sat emotionless in his chair, shackled at the ankles and arms. His only comment was to affirm his identity.
District Judge Michael Mullins maintained Bentler's previously set bond at $2.5 million, and appointed public defender David Sallen as Bentler's attorney.
Bentler is accused of gunning down Michael Bentler, 53; his wife, Sandra, 47; and their daughters Sheena, 17; Shelby, 15; and Shayne, 14, at the family's home just outside Bonaparte before dawn Saturday. Investigators have not provided a motive for the killings.
The mood in the courtroom changed moments after Bentler entered.
Relatives began weeping and embracing each other. Some doubled over, burying their heads in the arms and hands. Others simply stared at Bentler, occasionally shaking their heads in disbelief.
Assistant Attorney General Scott Brown asked Mullins to set Bentler's bond as cash only, citing the nature of the crime.
"It's the state's position that Shawn Bentler is too dangerous to be at large," Brown said.
If convicted, Bentler would face life in prison without parole.
Bentler was arrested Saturday near his home in Quincy, Ill. He waived extradition during a hearing Monday in Adams County, Ill., and was returned to Iowa later in the day.
Iowa authorities were alerted to trouble at the Bentler house at 3:38 a.m. Saturday when Shayne Bentler called 911 and said her brother was "going to do something." Next came the sound of a gunshot and someone yelling, "Shawn, no!"
Then the line went dead.
Authorities said they received a second 911 call at the same time from Sandra Bentler's cell phone, but it didn't reach a dispatcher. When a dispatcher tried to return the call, it went unanswered.
Funeral services for the family are scheduled for 10 a.m. Thursday at Harmony High School, about 10 miles south of Bonaparte, according to Schmitz-Lynk Funeral Home in Farmington. Visitation will be Wednesday evening at the high school, the funeral home said Tuesday.
